Environmental Management and Pollution Control (General Fees) Regulations 2007

New regulations, the Environmental Management and Pollution Control (General Fees) Regulations 2007, have been made. The regulations prescribe the fees charged under the Environmental Management and Pollution Control Act 1994 (EMPCA). The regulations will commence on 19 December 2007.

Fees prescribed are:

Annual permit fees prescribed in the new regulations are 77% higher than those prescribed under the superseded Environmental Management and Pollution Control (General Fees) Regulations 1995. Nonetheless, in the first year following the date of commencement of the regulations permit holders will pay only 50% of the fee increase. The full increase will apply in the second year.

The new annual fee structure will consist of two parts: a fixed component and a variable fee component. This new fee structure aims to improve cost recovery and to encourage permit holders to take greater responsibility for environmental management.

A partial remission of annual fees will be available to eligible permit holders that have a sound compliance record and meet certain other requirements, in accordance with regulations 9 and 10 of the new General Fees Regulations. Requirements for fee remissions are described in the Annual Fee Remission Guidelines.

Annual Fee Remission Guidelines

The Board of Environmental Management and Pollution Control has published the Annual Fee Remission Guidelines to describe its detailed requirements in relation to permit annual fee remissions that may be granted under regulations 9 and 10 of the new General Fees Regulations. Register of Fee Remissions

A public register of current annual fee remissions granted under regulations 9 and 10 of the new General Fees Regulations has been established.

EMPC (General Fees) Draft Documents

A public consultation on the draft General Fees Regulations and draft Annual Fee Remission Guidelines was conducted in June-July 2007. A regulatory impact statement was issued with the draft documents.
