The Environmental Management and Pollution Control Act 1994 (EMPCA) was enacted in 1994 to replace the Environment Protection Act 1973 as one plank of an integrated planning and environmental management system for Tasmania. This Resource Management and Planning System (RMPS) aims to ensure that all decisions about the use of land and natural resources in the State are made in pursuit of common objectives.
As with much contemporary legislation, an automatic review trigger is contained within EMPCA. In this particular case, the Minister must ensure that the statute is reviewed ten years after its commencement. Although EMPCA did not commence in its entirety until 1996, some provisions did commence in January 1995, hence the need to have the review substantially completed in 2005.
An Issues and Options Paper was prepared with detailed input from councils and other stakeholders as a key output of the 10-year statutory review of EMPCA. The Paper is dated December 2004 and is attached below.
Public comment was invited by 11 February 2005 on any issue or option canvassed. Views on the following topics were especially invited:
- the introduction of environmental authorisations
- referrals of level 1 and level 2 activities
- proposed changes to the enforcement of EINs
- a new instrument for addressing environmental nuisance.
The Report makes recommendations for a range of amendments to the Act to give effect to the conclusions of the review.

The Final Report consolidated the findings of the EMPCA 10 Year Statutory Review with the Tasmanian Legislation Review findings. The Report was table in Parliament on 18 October 2005.
